Terms of Service

1. Acceptance of Terms

By accessing or using Model Kombat ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Model Kombat is a platform for running blind AI model comparison tournaments. We provide tools to configure tournaments, submit prompts to multiple AI models, anonymize outputs, and facilitate judging and scoring.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete information during registration.

4. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Submit prompts that generate illegal, harmful, or abusive content
• Attempt to circumvent usage limits or security measures
• Interfere with or disrupt the Service or servers
• Reverse engineer or attempt to extract source code
• Use the Service to harm minors in any way
• Impersonate others or provide false information

5. Credits and Payment

The Service operates on a credit system. Credits are consumed when running tournaments. Purchased credits are non-refundable except where required by law. We reserve the right to modify pricing and credit costs with reasonable notice.

6. API Keys (BYOK)

You may provide your own API keys for supported providers. You are responsible for compliance with those providers' terms of service. We are not liable for charges incurred on your third-party accounts.

7. Intellectual Property

You retain ownership of your prompts and tournament configurations. AI-generated outputs are subject to the terms of the respective AI model providers. The Service, including its design, code, and branding, remains our intellectual property.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee the accuracy, reliability, or availability of AI model outputs or judging results. AI models may produce incorrect, biased, or inappropriate content.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of profits, data, or business opportunities.

10. Termination

We may suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms.

12. Governing Law

These terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
